What Kinds of Personal Injury Does The Law Cover

Must Read

Personal injury law is a branch of civil law that covers injuries or damages to one’s person. The law holds that the person who caused the injury is responsible for paying damages to the injured party for pain, suffering, or loss of enjoyment of life due to their injury.

What Kinds of Personal Injury Does The Law Cover

1. Bodily injury

The most obvious type of personal injury is bodily injury, which refers to injuries that result from the physical contact of two people. It can range from a simple bump to a serious injury like a broken leg.

2. Property damage

Property damage is damage to the possessions of another person. Typical examples are fire or water damage to your home or theft of your car, laptop, or money.

3. Wrongful death

Wrongful death is the death of another person as a result of negligence. This kind of personal injury involves being killed through the acts of others. For example, if someone hits you but does not realize you are walking behind them and does not stop in time to avoid hitting you. It can also occur when someone’s negligence results in the injury or death of your close relative, such as when an employer fires a gun into an area where his employee is standing and injures (or kills) him.

4. Modification/addendum

Modification or Addenda to personal injury law are other laws that have been added later to the original code of law, generally, after a new law has been passed.

Modification or addendum laws focus on specific aspects of personal injury law, for example, criminal prosecution for drug-related injuries, commercial trucking injuries, and human rights violations.

5. Statute of limitations/limitation

It refers to the maximum time a person has to file a personal injury claim. Statutes of limitation are usually placed at three years for bodily injury, but in some cases, the time limit may be longer.

6. Uninsured motorist

It refers to the driver of a vehicle who does not have the proper liability insurance to cover damages caused by their vehicle. Suppose you suffer an injury or damage resulting from an accident involving an uninsured motorist. In that case, your insurance company will pay for damages up to the coverage limits of your policy. The injured party may then seek to recover any damages or losses directly from the uninsured motorist.

7. Felony/criminal prosecution

Felony laws cover criminal prosecution for drug-related injury, commercial trucking injuries, and human rights violations. One will prosecute offenders in the court system for these offenses. They also may be prosecuted in civil court for property damage, bodily injury, or wrongful death.

8. Settlement

It refers to the legal process of the injured party and claimant coming to a settlement agreement wherein both parties agree on how much money each will receive. It is not necessarily a payment amount; it is more of an agreement between parties to end their dispute.

9. Personal injury protection

Personal Injury Protection is no-fault coverage provided by an insurance company separate from your health insurance plan in the case of a serious injury or accident. It helps to cover your medical costs and lost wages, so you will not have to worry about paying for them out of your pocket.

10. Medical malpractice

It is any type of negligence on the doctor’s part that leads to injury, loss of life, or suffering. Medical malpractice can be referred to as medical error or doctor error.

Conclusion

A person can also be sued by their employer if they were at work when the injury or damage occurred. An employee who is not at fault could sue their employer if they caused pain or suffering while they were on the job.
